sayless Terms of Service

These are the terms for using sayless, an app published by Nestfullabs ("we," "us"). By downloading or using sayless, you agree to these terms. If you don't agree, please don't use the app.
Please read this first: what sayless is, and isn't
This is a self-control and journaling tool for the period after a breakup, called sayless. It helps you track streaks, pause before you send a message you might regret, and keep a private record of why you made the decision you made.
This app is not therapy. It is not medical care, mental health treatment, or counseling. It is not a crisis service, and it is not a substitute for one. Nothing in the app is written, reviewed, or monitored by a licensed clinician, and no one is watching your usage in real time. It cannot know if you are in danger, and it cannot keep you or anyone else physically safe. If you are in crisis, thinking about harming yourself or someone else, or in an unsafe situation, please reach out to local emergency services, a crisis line in your area, or a licensed professional — not this app. We built sayless because we believe it can genuinely help with the ordinary, painful work of staying away from someone you shouldn't text. It was not built, and is not equipped, to be anyone's safety net.
Who can use sayless
You must be old enough to form a binding agreement in your jurisdiction, and to meet the minimum age described in our Privacy Policy, to use sayless.
Your account
You don't need an account to use sayless. If you choose to sign in with Apple to enable optional iCloud backup, you're responsible for keeping your Apple ID secure — we don't manage or have access to it.
Subscriptions
Optional premium features are offered through auto-renewing subscriptions, billed and managed entirely through your Apple ID / App Store account:
- Annual: $39.99/year, with a 7-day free trial for new subscribers
- Monthly: $9.99/month
We may also offer other purchase options from time to time; the price and terms for any such option are shown in the app and in the App Store before you buy.
Free trial. If a free trial is offered, your subscription will automatically begin and you will be charged unless you cancel at least 24 hours before the trial ends. We don't control this — it's Apple's standard subscription behavior, applied by the App Store to every trial.
Auto-renewal. Subscriptions renew automatically at the price and interval above unless cancelled at least 24 hours before the current period ends. Your Apple ID is charged for renewal within 24 hours of the end of the current period. Prices may change; if they do, Apple will notify you before any change takes effect, as required by App Store policy.
How to cancel. All subscriptions are managed through Apple, not through us — we have no way to cancel a subscription on your behalf. To cancel: open the Settings app on your device → your name → Subscriptions → sayless → Cancel Subscription. Or visit appstoreconnect.apple.com/manage-subscriptions. Uninstalling the app does not cancel your subscription.
Refunds. All purchases go through Apple, and all refunds are handled by Apple under their own refund policy — we do not process payments and cannot issue refunds directly. Request a refund at reportaproblem.apple.com or through your purchase history in the App Store.
Payment information. We never see or store your card details, billing address, or any other payment information. That entire relationship is between you and Apple.
Acceptable use
Please use sayless the way it's meant to be used: as a private, personal tool for your own self-control and reflection. Don't use it to:
- Harass, threaten, monitor, or track another person
- Store or share content that is illegal to possess or distribute
- Attempt to break, reverse-engineer, or interfere with the app's security or encryption
- Use the app in any way that violates the rights of others
We may suspend or restrict access to the app (to the extent we technically can — we do not operate accounts that could be centrally banned) for serious or repeated violations of these terms.
Your content
Everything you create in sayless — your written entries, recordings, photos, and drafts — belongs to you. We don't claim any ownership over it, and as described in our Privacy Policy, we generally cannot see it: it's encrypted on your device with a key that never leaves your phone. You are solely responsible for the content you create and store in the app.
No warranty
This app is provided "as is" and "as available." We do not guarantee that the app will be uninterrupted, error-free, or perfectly secure, that it will help you achieve any particular outcome, or that any specific result (avoiding contact, healing, "success") will occur from using it. To the fullest extent permitted by law, we disclaim all warranties, express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
Limitation of liability
To the fullest extent permitted by Quebec, Canada law: sayless and Nestfullabs are not liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, arising from or related to your use of the app. This includes, without limitation, any harm arising from a decision you made or didn't make based on the app, from data loss (including vault content that cannot be recovered once its on-device encryption key is deleted, as described in the Privacy Policy), or from any situation the app was not designed or able to prevent, including but not limited to the safety concerns described at the top of these terms. Our total liability for any claim relating to the app will not exceed the amount you paid us, if any, in the twelve months before the claim arose.
Nothing in this section limits liability that cannot be limited under applicable law.
Changes to the app or these terms
We may update sayless and these terms over time. If we make a material change to these terms, we'll update the effective date above and, where required, notify you in the app.
Governing law
These terms are governed by the laws of Quebec, Canada, without regard to its conflict-of-law principles.
